KarYard California Privacy Notice

This PRIVACY NOTICE FOR CALIFORNIA RESIDENTS supplements the information contained in our Privacy Policy of KarYard.com (“KarYard”,“we,” “us,” or “our”) and applies solely to visitors, users, and others who reside in the State of California (“consumers”, “residents”, or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) updated January 1, 2023, and other California privacy laws. Any and all terms defined in the CCPA have the same meaning when used in this Notice.

Personal Information Categories

“Personal information” means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. The below categories of information constitute Personal information if it identifies, relates to, describes, directly or indirectly, with a particular consumer or household.

A.) Identifiers. "A real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, Social Security number, driver’s license number, passport number, or other similar identifiers."
B.) "Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e))." A name, signature, Social Security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. Some personal information included in this category may overlap with other categories.
C.) Protected classification characteristics under California or federal law. Age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status, genetic information (including familial genetic information).
D.) Commercial information. Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
E.) Biometric information. Genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as, fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data.
F.) Internet or other similar network activity. "Browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement."
G.) Geolocation data. Physical location or movements.
H.) Sensory data. Audio, electronic, visual, thermal, olfactory, or similar information.
I.) Professional or employment-related information. Current or past job history or performance evaluations.
J.) "Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99))." Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records.
K.) Inferences drawn from other personal information. Profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

We may use or disclose the personal information we collect for one or more of the following business purposes:

We may disclose your personal information to a third party for business purposes. As an example, your information is sent to participating dealers when you inquire about a listing on our site. That information is sent to the dealer so they may respond to your request. When we disclose personal information for a business purpose, the participating dealer is not bound by our privacy policy. Your Rights & Choices

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Rights to Data Portability & Access to Specific Information

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • Categories of personal information collected about you.
  • Categories of sources for personal information collected about you.
  • Our business purpose for collecting or selling that personal information.
  • Categories of third parties with whom that personal information was shared.
  • Which pieces of personal information were collected about you (data portability request).
  • If your personal information was sold or disclosed for a business purpose; information will be in one of two formats :
    • sales format: including personal information categories and each purchased by the recipient.
    • disclosure format: including personal information categories and each category of recipient obtained for a business purpose.

Deletion Request Rights

You have the right to request we delete any of your personal information that we retained once collected from you, subject to some exceptions. Once we have received, confirmed, and verified your consumer request, we will delete your personal information from our records, unless there is an exception that applies.

Your request for deletion request may be denied if retaining the information is necessary for us or our service providers to:

  1. Complete any transaction for which the personal information was collected, provide a good or service requested by you, complete actions based on business dealings with you, or properly fulfill our contract or obligations with you.
  2. Troubleshoot and repair products to identify and repair errors that impair functionality.
  3. Detection of security items, protect against deceptive, fraudulent, illegal or malicious activity, or prosecute any parties responsible for these types of activities.
  4. Engage in any research in the public interest that adheres to all applicable privacy laws & ethics, when the deletion of the information may impair the success of the research if informed consent was already provided.
  5. Use for reasonable internal use that is consistent with the nature of the service we are providing you. Any lawful use associated with that service.
  6. Exercise of any and all rights including free speech for ourselves or on behalf of our clients, colleagues, partners, and patrons.
  7. Complying with any legal obligation. Including the California Electronic Communications Privacy Act.

Exercising Data Portability, Access, and Deletion Rights

To exercise the rights described above, please submit a verifiable request to us by either:

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable request related to your information. A verifiable request on behalf of your minor child by you. A verifiable request for access or data portability may only be made twice within a 12-month period.

The verifiable consumer request must:

  • Deliver sufficient information that allows us to verify you are the person we collected personal information about or an authorized representative.
  • Deliver sufficient information with enough detail so we may understand, review, and respond to your request. We must be able to verify your identity or validate your authority to make the request and confirm the requested information relates to you. We will only use the information provided to verify your identity or authority to do so.

The Response Process & Timing

We make an effort to respond to verifiable consumer requests within 45 days. If more time is needed, we will inform you why we need additional time; up to 90 days. All disclosures provide coverage for a 12-month period prior to verifiable receipt of the consumer’s request. In our response, we will explain any reason we may not be able to comply with the request, if applicable.

Format information will be provided by us for any data portability requests for secure delivery.

Some fees may apply to information requests if it seems necessary. An explanation will be provided in the event a fee will be applied. Fees will not be applied to first requests.

Non-Discrimination

We do not discriminate against you for exercising any  CCPA rights. Unless permitted by the CCPA, we will not:

  • Charge different prices for the same goods or services to you.
  • Deliver a different quality of goods or services to you.
  • Deny any goods or services to you.

Privacy Notice Changes

We reserve the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will notify you by email or through a notice on our website homepage.
